Summary of Case: On June 21, 2004, the plaintiff was driving his car on Highway 7 when an underinsured motorist failed to yield the right of way and pulled directly into the plaintiff’s path. The impact occurred with the vehicles traveling approximately 45 mph. The plaintiff suffered a large gash in his head from the impact and was rendered unconscious. The laceration required six staples. He also experienced back and neck pain, difficulty swallowing, a left rotator cuff injury, left hand and arm numbness and severe headaches. A large cut over his eye required eight stitches. Medical special damages were $132,754.42. The majority of those were paid through the plaintiff’s health-care carrier. The health carrier was reimbursed out of the settlement with the liability carrier.
